The fee always depends on the agreement of the parties. Exact price quotation might be given with full knowledge of the facts.

Rate of fees (recommended) of the bar association can be read below as information.

Rate of fee of lawyers:

I. Rate of fee in judicial procedures:

1. fees of extrajudicial procedures:

  • warrant for payment
  • other extrajudicial procedures
  • if the sum in dispute can not be defined in the cases afore-mentioned the fee is 30.000,- Ft.

2. fees of legal proceedings:

  • lawsuit for judicial review of an administrative decision
  • lawsuit for contestation of social security decision
  • if the sum in dispute can not be defined in the cases afore-mentioned the fee is 50.000,- Ft.
  • action for damages
  • lawsuits deriving from obligatory relations
  • lawsuits deriving from employment relations
  • lawsuits deriving from dwellings
  • lawsuits for expropriation
  • if the sum in dispute can not be defined in the cases afore-mentioned the fee is 50.000,- Ft.

3. Fees in the proceedings of legal remedies

  • Appellate procedure is 50% of the fee of the first instance proceeding
  • Renewal of a lawsuit is 100% of the fee of the first instance proceeding
  • Review procedure is 100% of the fee of the first instance proceeding

4. Fees in criminal trials

In private prosecution procedures:

  • As the proxy holder of the accuser – offended party the fee is at least 20.000,- Ft.
  • As the lawyer of the person charged with, the fee is at least 20.000,- Ft.

In popular actions:

  • Pleading during the investigation the fee is at least 25.000,- Ft
  • As a defense counsel at the court the fee is at least 25.000,- Ft.
  • If the pleading is from the beginning of investigation to delivering the sentence the fee is at least 50.000,- Ft.
  • As a proxy holder of the offended party the fee is 15.000,- Ft.

The fees recommended above are trendsetting information in popular actions, delinquency procedures, the fees could be determined by 50% higher in criminal procedures.

50 % of the fees recommended above are trendsetting in the second instance procedures. The sums above-mentioned do not consist of refunding of expenses arisen neccessarily during providing the case e.g.: the costs of travelling to a detention facility.

If, because of the nature of the case, the condition of fee would be unfair either to the mandator or to the mandatee on the basis of above written so the determination of the fee is recommended proportionally to time spent defending and representing the offended party, the remuneration is to reach the minimum of 5.000,- Ft per hour spent to the case.

II. Fees in case of conclusions of a contract and corporate matters

The fee is increased by 20% VAT and the flat charge of 20% of the remuneration raised by VAT./p>

1. Contract of sale

The fee is to be determined on the basis of the purchase price

  • up to 10.000.000,- Ft it is 1% of the purchase price but min. 30.000,- Ft.
  • Over 10.000.000,- Ft it is 100.000,- Ft
  • + 0,5% of the proportion over 10.000.000,- Ft but min. 50.000,- Ft.

2. Swap of real estates

The base of the fee is the value received after selling the real estate having higher price in accordance with the table of fees of contracts.

3. Abolishment of joint property:

  • The base of the fee is the value of the joint property to divide in accordance with the table of fees of contracts.

4. Other contracts:

  • The value of the case may be determined: in accordance with the table of fees of contracts.
  • The value of the case may not be determined: the time spent to the activity in accordance with the fee of the consultancy paid for an hour.

The fee consists of: the value received for the completion and countersignature of deeds neccessary to the alteration of registration affecting to the land register, for the activity of the lawyer relating to the representation in the proceedings of the land registry and to the office dealing with duties e.g.: stamp duty. The fee also consists of 2 hours of councelling and consultancy. The number of copies of deeds are 5.

5. Corporate cases:

Foundation::

Foundation of corporations not being regarded as legal person is min. 50.000,- Ft.

Foundation of legal person

  • limited liability company,
  • non-profit organization min. 100.000,- Ft
  • public limited company, joint enterprise min. 200.000,- Ft
  • foundation, association min. 50.000,- Ft

Modification:

  • 30% - 70% of the fee in case of foundation of a company which depends on the nature of the modification but min. 20.000,- Ft

Foundation of a legal person

  • 30% - 70% of the fee in case of foundation of a company which depends on the nature of the modification but min. 30.000,- Ft

Activity relating to the abolishment of companies without successor (ultimate payment).

Renumeration is equivalent to the fee of the foundation of a company.

The remuneration includes: the value recevied of the countersignature of the completion of deeds neccessary to registration of foundation of a company, the activity of the lawyer relating to the representation in the Registry Court proceedings, 2 hours of councelling and consultancy. The number of copies of deeds are 5.

III. Remuneration of a lawyer on the basis of time spent to the case:

In this case, the time necessary to preparations and settlement should be added on the remuneration. Depending on the case complexity double remuneration may be determined at most.

  • for each hour begun it is at least 15.000,- Ft
  • after each hour of consultancy begun it is 15.000,- Ft.
  • consultancy in foreign language is 20.000,- Ft/hour.

IV. Refunding of expenses:

The lawyer charges either for the out-of-pocket expenses or for flat charge.

1. Out-of-pocket expenses:

  • out-of-pocket expenses includes the costs of telephone calling, travelling, accommodation, copying and other costs arisen in relation to providing the case

2. Flat charge:

  • 20% of the remuneration of the lawyer might be charged for as flat charge instead of the itemized settlement of out-of-pocket expenses in relation to the fulfilment of assignment. The flat charge involves the translation costs and all costs related to the fulfilment of assignment.
